Qualifying Criteria:
- Be located within the South West region; Cornwall & the Isles of Scilly, Devon, Somerset, Dorset, Gloucestershire, Wilshire or the Channel Islands.
- Supply up to date copy about your business to Taste of the West as required.
- Comply with all relevant Trading Standards and consumer protection legislation currently in force.
Definition of Terms:
“The Company” means Taste of the West Ltd.
“The Member” means a business or individual that has paid the agreed Taste of the West membership subscription for that year or period.
“The Directors” means Taste of the West’s Board of Directors.
Terms and Conditions:
These terms and conditions are to be read in conjunction with the relevant membership literature and application form, and all these documents represent the entire agreement of the parties.
The laws of England will apply to the subject matter of these terms and the English courts will have exclusive jurisdiction in relation to any dispute arising out of or in connection with these terms.
By joining The Company you are stating that your business values closely relate to the values of The Company and its other Members.
The Member acknowledges that as a Member they will be bound by the rules and regulations relating to Members as prescribed by the Directors. The Company reserves the right to alter and amend these terms and conditions from time to time, as necessary.
In particular, the Member undertakes that he/she will pay the annual subscription that the Directors have resolved to charge Members of that year.
The Company offers on-going membership. This means that at the end of each membership period, the subscription will automatically renew unless cancelled.
Should the Member decide to cancel their subscription, notice must be given in writing to the Company not less than one month before the subscription renewal date. If notice is received after the renewal date, membership will be charged on a pro-rata basis for the months that have passed since the date of renewal.
The Member is required to immediately inform the Company, by email, of any changes to your correspondence address(es). The Company will not be held liable for any non-receipt of communication from the Company, including, but not limited to, any renewal reminders.
The Member will use the best endeavours to promote the Company’s aims and objectives and shall not do anything that prejudices or in any way denigrates the interests of The Company. The Directors reserve the right to terminate this agreement at any time, at their discretion.
Membership implies a commitment to the development of quality regional food and drink related businesses in the South West of England. Each Member will, therefore, do his/her utmost to maintain and improve the standard of any of the businesses it is working with.
Marketing: The Member guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Taste of the West for inclusion on our website, or other design, are owned by the Member, or that the Member has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend Taste of the West and its subcontractors from any liability (including solicitors fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by the Member. Evidence of ownership or permissions may be requested by Taste of the West.
Members are expected to at all times to comply fully with their obligations under any Act of Parliament, Order, regulations or relevant Code of Practise.
In entering into membership of The Company it is hereby acknowledged by the Member that The Company, its Directors and Staff shall not be made party to any contractual arrangements as between that Member and any third party whether expressly or by implication.
In granting membership to any person or business, The Company does not act in any way as an agent for the Member. Any sales promotion, advertising and sale of goods is, and shall remain the sole responsibility of the Member. The Company reserves the right to require any Member to alter, remove or cease from, any sales promotion, and sale of goods associated with Taste of the West Ltd. that contravenes any Act of Parliament, Order, Regulation or Code of Practice, that brings or is likely to bring Taste of the West Ltd. into disrepute.
Data Protection: Taste of the West takes great care in dealing and processing your data in accordance with the provisions of the General Data Protection Regulation 2018. In entering into membership of Taste of the West Ltd. it is hereby acknowledged by the Member that Taste of the West will circulate and promote the contact details of its members. Filtered copies of the membership database (containing only contact information) are provided as a membership benefit. It is not permissible for Members, or The Company to circulate The Company’s membership database beyond the remit of the membership or to any third party, without the expressed consent of the Member and the Company. There is an opportunity for Members to opt out of this benefit on the membership application form, should the Member not wish to benefit from this service.
Limitation of liability of the Company: Should the Company be in breach of its responsibilities and obligations on membership, the liability is limited to the annual membership subscription.
From time to time The Company attracts public funding to assist with its work. Where a Member benefits from such funded activity, it is a condition of their involvement that the Member provides feedback, when requested by the Company.
Intellectual property: The Company logo is trademarked, and can only be used in accordance with the terms and conditions of membership, for the purpose of promotion of the Member and the Company. The licence to use the Company’s logo will be terminated immediately, if membership is terminated by either party.
